I have the honour to state that a question

has been raised whether the grant by the Governor-in-Council of provisional protection of an invention under section 11 of the Patents Ordinace, 1892, may prejudice an application for grant of Letters Patent in England, by reason of the prior publication of the invention in Hongkong.

I enclose a copy of the clause in question,

for convenience of reference.

I shall be glad if the matter may be referred to the Law Officers of the Crown. The difficulty may perhaps be met by the making of an Order-in-Council under section 91 (5) of the Patents and Designs Act, 1907.
